Terms of Service

These terms govern your use of FastTile and include the software license that applies when you download, install, activate, or use the app.

Scope and acceptance

These Terms of Service and End User License Agreement ("Terms") apply to the FastTile macOS application, website, License Keys, software updates, license management, and support services.

These Terms are between you and 深圳轻海网络科技有限公司 (Shenzhen Qinghai Network Technology Co., Ltd., the English business name we use internationally), a company established in the People's Republic of China ("FastTile," "we," "us," or "our"). Our business address is Room 537, Building 51, No. 5 Qiongyu Road, Nanshan District, Shenzhen, Guangdong, China. Questions about these Terms may be sent to support@fasttile.app.

By purchasing a license or downloading, installing, activating, or using FastTile, you agree to these Terms. If you do not agree, do not purchase, install, activate, or use FastTile. If you act for a company or another organization, you confirm that you have authority to accept these Terms on its behalf.

You must be legally capable of entering into these Terms. If you are not, a parent, guardian, or other authorized representative must accept them on your behalf.

Software license and device limits

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and non-sublicensable license to install and use FastTile for personal or internal business purposes. After you pay the applicable one-time purchase price, the license for the plan you purchased is perpetual.

The number of Macs permitted by your license is the activation limit stated on the product or checkout page, in your order confirmation or receipt, in the entitlement associated with your License Key, or in another written confirmation from us. If no activation limit is specified, the license is limited to one active Mac. Virtual machines and other macOS environments capable of activating FastTile may count as separate Macs.

You may move an activation to a replacement Mac by deactivating FastTile on the previous Mac and activating it on the new one, subject to your activation limit and reasonable anti-abuse controls. A license may not be transferred to another person or organization without our written permission.

FastTile is licensed, not sold. These Terms give you permission to use the app but do not transfer ownership of FastTile, its source code, branding, or other intellectual property.

License restrictions

You must not, and must not help others to:

  • copy, modify, adapt, translate, distribute, rent, lease, lend, sell, resell, sublicense, or commercially exploit FastTile except as these Terms expressly permit;
  • share, publish, sell, or otherwise provide a License Key to an unauthorized person;
  • bypass or interfere with activation, validation, device limits, update security, or other technical protections;
  • reverse engineer, decompile, disassemble, derive source code from, or inspect the internal implementation of FastTile, except to the limited extent that non-waivable law expressly permits;
  • remove or alter copyright, trademark, attribution, or other proprietary notices; or
  • use FastTile unlawfully, to infringe another person's rights, or in a way that harms, disrupts, or compromises our software, licensing systems, or services.

Activation and license management

Internet access may be required to activate, validate, deactivate, transfer, or manage a License Key and to check for updates. Temporary offline use may be available after a successful validation, but uninterrupted offline access is not guaranteed.

We may reject an activation or suspend or revoke a License Key when we reasonably determine that it is associated with fraud, a reversed or refunded payment, unauthorized sharing, circumvention of technical protections, excessive activation abuse, or another material breach of these Terms. Where appropriate, we will provide notice and a reasonable opportunity to resolve the issue.

Information used for licensing and activation is handled as described in our Privacy Policy.

Purchases, prices, and payment

FastTile licenses are sold for a one-time fee and do not automatically renew. Current prices, currencies, taxes, discounts, payment methods, plan details, and the total amount due are shown at checkout. We may change prices prospectively, but a later price change does not alter a completed purchase.

Freemius, Inc. ("Freemius") acts as merchant of record and authorized reseller for FastTile purchases. Freemius processes payment, billing, applicable taxes, fraud screening, receipts, and transaction-related customer service. Your purchase is also subject to the buyer terms, payment terms, and other notices presented by Freemius at checkout.

If these Terms conflict with terms presented by Freemius, Freemius's terms control only for payment processing, billing, taxes, and transaction administration. These Terms continue to govern your license to and use of FastTile.

Refund policy

FastTile uses a 14-day strict money-back guarantee. If, during the first 14 days after purchase, a verified defect makes FastTile's material functions unusable and, after your reasonable cooperation with our support team, we cannot resolve the problem, you may request a full refund or a replacement, non-defective product.

This guarantee does not cover a change of mind, a missing feature, failure to review system requirements, or a conflict or incompatibility with third-party hardware, software, or services. Refund requests outside this guarantee may be considered at our discretion where permitted by law.

Refunds are requested and processed through Freemius or the support channel identified above. If a refund is issued, the related license may be deactivated and you must stop using the paid version of FastTile. Nothing in this section limits any refund, repair, replacement, or other remedy that applicable law does not allow us to exclude.

Updates, compatibility, and support

A paid license includes all future FastTile updates that we make generally available to paid license holders under the same product, at no additional charge. Your license does not expire merely because a new FastTile update is released.

This update commitment does not require us to develop, release, maintain, or support FastTile indefinitely, follow a particular release schedule, or include a separately branded product, service, or paid add-on. We may change or discontinue features, update channels, or compatibility targets for legitimate security, legal, technical, or product reasons.

System requirements are stated on the FastTile website or in release notes and may change for future versions. We do not guarantee compatibility with every Mac, future macOS release, third-party application, display configuration, or other software.

We provide reasonable email support for FastTile but do not promise a particular response time or that every issue can be resolved. Any additional support commitment must be stated in a separate written agreement.

Intellectual property

FastTile, including its software, source code, design, documentation, artwork, names, logos, and related materials, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual-property laws. All rights not expressly granted by these Terms are reserved.

Third-party services and components

FastTile may interact with or link to third-party services, including Freemius. Those services are operated independently and may be subject to their own terms and privacy notices. We are not responsible for a third party's services except to the extent required by applicable law.

FastTile may include third-party software components governed by their own license notices. Those notices apply to the relevant components and do not expand the license granted to FastTile as a whole.

Suspension and termination

You may stop using FastTile at any time. These Terms remain in effect for as long as you possess or use FastTile or access its related licensing and support services.

We may suspend related services or terminate your license if you materially breach these Terms and do not cure the breach after reasonable notice, when a cure is appropriate. We may act immediately where reasonably necessary to address fraud, unlawful conduct, security risk, unauthorized License Key sharing, payment reversal, or deliberate circumvention.

When a license terminates, you must stop using the paid version of FastTile and remove copies in your possession or control. Provisions that by their nature should survive termination, including ownership, restrictions, disclaimers, liability limits, and dispute provisions, will survive.

Disclaimer of warranties

To the maximum extent permitted by applicable law, FastTile and its related services are provided "as is" and "as available." We do not guarantee that FastTile will be uninterrupted, error-free, completely secure, compatible with every application or system configuration, or suitable for every purpose. We disclaim implied warranties to the extent they may lawfully be disclaimed. This section does not exclude any statutory warranty or guarantee that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business, opportunity, goodwill, or data, arising from or related to FastTile or these Terms.

To the maximum extent permitted by applicable law, our total aggregate liability arising from or related to FastTile or these Terms will not exceed the amount you paid for the FastTile license giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including where applicable liability for fraud, willful misconduct, gross negligence, death or personal injury, or breach of non-waivable consumer rights.

Consumer rights

Nothing in these Terms limits rights or remedies that applicable consumer law does not permit you to waive. If a provision of these Terms conflicts with a mandatory law that applies to you, that mandatory law controls to the extent of the conflict, and the remaining provisions continue to apply.

Resolving disputes and applicable law

Before starting formal proceedings, you and FastTile agree to make a reasonable, good-faith effort to resolve the dispute informally by contacting the other party and describing the issue and requested resolution. This does not prevent either party from seeking urgent relief where necessary.

The law governing these Terms and the courts or other forums having jurisdiction over a dispute will be determined under applicable law. Nothing in these Terms deprives a consumer of the protection of mandatory laws or access to a court or forum that cannot lawfully be excluded by agreement.

General terms

These Terms, together with the terms presented at checkout and any other written terms expressly incorporated into them, form the agreement relating to your purchase and use of FastTile.

If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver of it.

You may not assign or transfer your rights under these Terms without our written permission. We may assign these Terms as part of a merger, reorganization, sale of assets, or transfer of the FastTile business, provided that your purchased license rights remain subject to applicable law.

Changes to these Terms

We may update these Terms prospectively when FastTile, our business practices, or applicable requirements change. We will post the revised Terms on this page and update the date above. If a change is material, we may also provide notice through the app, website, or email.

We will not use an update to these Terms to retroactively reduce the number of Macs permitted by a completed purchase or convert a perpetual license into a recurring subscription. The Terms in effect when you purchased FastTile continue to govern the license rights acquired in that purchase, except where a change is required by law or accepted by you.
